"Passenger Declaration" means the digital form and signature capturing process required for CAA cost sharing compliance;
"User" means a user of Our Service;
"User Content" means content, data, and information shared by Users on Our Service; and
"We/Us/Our/BBJT" means BBJT (William Beacroft & Joseph Taylor).

7. User Accounts

Certain features on Our Service, including the ability to create and manage passenger declarations, may require an Account.

Only Users aged 18 or over may create an Account.

When creating an Account, the information you provide must be accurate and complete. If any of your information changes, it is your responsibility to ensure that your Account is kept up to date.

We recommend that you choose a strong password for your Account, consisting of a combination of lowercase and uppercase letters, numbers and symbols.

It is your responsibility to keep your Account details safe. If you believe your Account is being used by someone else without your permission, please contact Us using the details above in Section 3.

You must not use another person's Account.

All personal information provided by you in your Account will be collected, used, and held in accordance with your rights and Our obligations under data protection law, as set out in Our Privacy Policy.

If you wish to delete your Account, you may do so at any time. Deleting your Account will result in the removal of your information from Our Service, subject to our data retention requirements for CAA compliance purposes.

We may disable your Account if, in Our reasonable opinion, you have breached these Terms of Service.

8. Acceptable Usage of Our Service

You may only use Our Service in a lawful manner:

  • You must ensure that you comply fully with any and all local, national, or international laws and regulations that apply;
  • You must not use Our Service in any way, or for any purpose, that is unlawful or fraudulent; and
  • You must not use Our Service to knowingly send, upload, or in any other way transmit data that contains any form of virus or other malware.

If you fail to comply with the provisions of this Section 8, you will be in breach of these Terms of Service. We may take one or more of the following actions in response:

  • Suspend or terminate your right to use Our Service;
  • Issue you with a written warning;
  • Take legal proceedings against you for reimbursement of any and all relevant costs;
  • Take further legal action against you, as appropriate;
  • Disclose such information to law enforcement authorities as required or as We deem reasonably necessary; and/or
  • Any other actions which We deem reasonably appropriate (and lawful).

9. How You May Use Our Service and Content (Intellectual Property)

With the exception of User Content, all Content included on Our Service and the copyright and other intellectual property rights in that Content belongs to or has been licensed by Us, unless specifically labelled otherwise. All Content is protected by applicable United Kingdom and international intellectual property laws and treaties.

You may access, view, and use Our Service in a web browser and you may download Our Service (or any part of it) for caching.

You may print one copy and download extracts of any page(s) from Our Service for personal use only.

You may not use any Content from Our Service for commercial purposes without first obtaining a licence from Us.

Our status as the owner and author of the Content on Our Service must always be acknowledged.

10. User Content

User Content on Our Service includes passenger declaration data, flight information, and any other data you provide to us.

An Account is required for the submission of User Content to Our Service.

All User Content must comply with applicable laws and regulations, including CAA requirements for passenger declarations.

You warrant that any User Content you provide is accurate and complete. You will be liable to Us and will indemnify Us for any breach of your warranty.

We are not responsible for any loss of User Content submitted to Our Service. It is your sole responsibility to secure and backup your User Content.

We may reject, reclassify, or remove any User Content from Our Service where, in Our sole opinion, it violates these terms or applicable laws.

When you submit User Content to Our Service, you grant Us a licence to use, store, archive, and process your User Content to the extent necessary to operate Our Service and comply with CAA regulations.

11. Disclaimers

Nothing on Our Service constitutes professional aviation or legal advice on which you should rely. It is provided for general information purposes only.

We make reasonable efforts to ensure that Our Content on Our Service is complete, accurate, and up to date, but to the extent permitted by law, We make no warranties, representations, or guarantees (express or implied) that this will always be the case.

If you are a business user, We exclude all implied representations, warranties, conditions, and other terms that may apply to Our Service and Content.

12. Our Liability

Nothing in these Terms of Service excludes or restricts Our liability for fraud or fraudulent misrepresentation, for death or personal injury resulting from negligence, or for any other forms of liability which cannot be lawfully excluded or restricted.

If you are a business user, to the fullest extent permissible by law, We accept no liability for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) Our Service or the use of or reliance upon any Content included on Our Service.

Any and all such breaches will be reported to the relevant law enforcement authorities and We will cooperate fully with those authorities. If you are a consumer, any dispute, controversy, proceedings, or claim between you and Us relating to these Terms of Service or to the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.

If you are a business user, any dispute, controversy, proceedings, or claim between you and Us relating to these Terms of Service or to the relationship between you and Us (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
